EU Deforestation Law Effectively 'Dismantled' After High Hopes
It was a pioneering piece of legislation that would curb the global scourge of forest loss.
But, the revised version of the EU's deforestation regulation, previously touted as the crown jewel of the European Green Deal, has been passed in a severely weakened state, prompting alarm from its original architect and environmental politicians.
"The regulation was gutted," stated the law's original author, citing the removal of crucial requirements for downstream traders to check the origin of products like palm oil, soy, wood, beef, rubber, cocoa and coffee.
He warned that a reduced number of responsible companies, less information collected, and imprecise sourcing details would complicate the task of authorities.
A Watered-Down Law
Green party MEP Marie Toussaint went further, labeling the postponements, exceptions and new loopholes – such as one for paper goods – as the "systematic weakening" of the law.
This outcome is a far cry from the hopes of over 1.2 million EU citizens who signed a petition in 2020 demanding a prohibition of deforestation-linked products.
At its launch in 2021, then-Green Deal commissioner the European commissioner called it "the toughest law ever put forward to fight forest loss."
A Story of Dilution
The law's unravelling is seen by critics as the European Union retreating from its environmental promises. It faced significant delays, ostensibly over technical problems, which sparked criticism.
"By revisiting the legislation instead of solving a simple IT problem, authorities invited political interference," commented Toussaint.
In its first draft, the regulation mandated that firms to trace goods to their exact plot of land using geolocation data, holding them accountable for deforestation in their supply chains with criminal charges and hefty fines.
"It wasn't bureaucracy for its own sake," Schally said. "These rules were the tool that made the rules enforceable, established traceability, and prevented firms from obscuring their activities behind opaque production networks."
Mounting Pressure
Yet, the rigorous checks provoked opposition in the EU capital from multinational corporations, exporting nations, rightwing parties and EU logging states.
Analysts point to last year's European Parliament elections as a decisive moment, shifting the balance of power more skeptical of green regulations.
"The other pressure has come from major export markets outside the EU," noted corporate sustainability professor, implying the commission gave in to some demands in trade talks.
Key Loopholes Introduced
The passed law features several critical weakenings:
- Retailers and traders were mostly exempted from conducting rigorous checks.
- A new “low risk” category was created.
- A option for more reductions was opened for next spring.
- Only a handful of nations – Russia, Belarus, North Korea and Myanmar – will face “high risk” scrutiny.
"Instead of tightening rules for companies, it rolled them back," said the law's author. "By shifting responsibilities to producers, it lessened the number of responsible firms."
Uncertainty for Companies
The protracted process and revisions have also created annoyance for businesses that complied early.
"It is very frustrating because we put a lot of effort into preparing," stated Xavier Rombouts. "We invested in software, followed seminars and built a team... now they’re saying it may be changed. It’s a major letdown."
The Commission's Stance
An EU representative defended the outcome, saying: "We have listened to concerns and acted to ensure a pragmatic and balanced implementation."
