New Jersey's top prosecutor steps down following appeals court deems ineligible her appointment.

The ex-lawyer for the former president has stepped down as the US Attorney for New Jersey. This comes after a judicial decision that questioned her legal standing to occupy the role.

Acceptance of Resignation

The nation's top law enforcement official, Pam Bondi, confirmed Habba's resignation on the start of the week. In a statement that the appeals court finding made it "untenable" for the official to lead the department effectively.

"Do not interpret adherence to the ruling as defeat," she declared. "The effort will now reach across the nation."

Court Ruling

Habba's exit comes a week after a federal appellate panel determined that she had been serving in violation of the law as the federal prosecutor. This ruling is could influence numerous legal proceedings in the state.

The court ruled that a temporary posting that bypassed Senate approval breached the Federal Vacancies Reform Act.

Future Role and Reaction

Bondi said that the former prosecutor will stay on at the Department of Justice as a senior adviser. Habba plans to seek further review of the disqualification, with hopes of a different outcome.

Writing online, she contended that the court "must not second-guess the executive's selection of prosecutors tasked with carrying out the executive branch's core responsibility of criminal prosecution."

Bondi commended Habba's record and pointed out that during her run, the state capital of Newark saw a significant drop in crime. She also stated that the southern city of Camden recorded its initial homicide-free summer since 1974 free from homicides.

Legal Career

The 41-year-old attorney, was initially recruited to Donald Trump's lawyers in recent years. She went on to defended her client in his New York criminal case in 2024, when he was conviction on multiple felony counts of falsifying business records.

Prior to Habba took on the federal prosecutor position, Trump had revealed he was appointing her as his presidential counsellor if re-elected, calling her as deeply loyal and a "tireless advocate for justice".
