US Judge Orders Freedom of Kilmar Abrego Garcia from ICE Detention
A federal judge has ruled the immediate release of Kilmar Abrego Garcia from immigration custody, finding his ongoing detainment lacks lawful basis.
"Since his return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her ruling.
The situation originates in a erroneous deportation to El Salvador earlier this year, which the government later acknowledged was an error. After his repatriation to the United States to answer alien smuggling charges, he was detained in federal custody.
In her order, the court noted that the government lacks a valid removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."
